Lockme.pl Terms and Conditions

The lockme.pl service Administrator is as follows: Jakub Caban, conducting a business activity with the following name: “Lockme Jakub Caban” with its registered office in Wrocław (53-601), ul. Tęczowa 7, entered to the Central Registration and Information on Business, holder of the following VAT ID: 898-209-36-73.

§ 1 Definitions

For the purposes of these Terms and Conditions, the following definitions shall be used herein:

  1. Administrator – Jakub Caban, conducting a business activity with the following name: “Lockme Jakub Caban” with its registered office in Wrocław (53-601), ul. Tęczowa 7, entered to the Central Registration and Information on Business, holder of the following VAT ID: 898-209-36-73.

  2. Consumer – a natural person using the Service in a way that is not associated with the business or professional activity conducted by them,

  3. Account – account in the Service managed by the Administrator for a User registered on the basis of an Account Management Contract; an Account is a collection of resources where data of a Registered User is gathered as well as information about activities undertaken within the Service,

  4. Room – escape room, which is described in the Service,

  5. Terms and Conditions – these Terms and Conditions available at https://lock.me/regulations/,

  6. Room Regulations – Regulations provided by the Room Owner, which feature provisions regarding the use of a Room,

  7. Service – website available at https://lock.me,

  8. Payment system – electronic payment service,

  9. Account Contract – contract concluded between the user and Administrator, in line with § 5 item 3 of the Terms and Conditions, under which the Administrator is obliged to manage the User's Account in the Service, and the User is obliged to use the Service according to these Terms and Conditions,

  10. Room Booking Contract – contract concluded between the User and Room Owner, in line with § 6 item 12 hereof, under which the Room Owner is obliged to provide a Room to a User on the date and time selected by the User and on principles specified in the Room Regulations, while the User is obliged to make a payment to the Room Owner, whereas the payment shall be made in advance via the Service mechanisms,

  11. User – any entity using the Service,

  12. Registered user – natural person, legal person or legal entity with limited legal capacity holding an Account in the Service; if a User is mentioned in the Terms and Conditions, this also applies to a Registered User,

  13. Voucher – a product voucher issued to the bearer's name, which may be redeemed only via the Service as a form of payment for Room booking; the principles of acquiring and using Vouchers are described in Regulations will be available soon.

  14. Room Owner – an entity conducting a business, providing their Room(s) even if such Room(s) are not visible in the Service.

 

§ 2 Preliminary Provisions

  1. The Administrator provides the Service, through which electronic services are provided to the User in a method and on principles specified herein.

  2. The Terms and Conditions define the following:

    1. principles of Service use,

    2. rights and obligations of the Administrator and User regarding the use of the Service.

  3. Details regarding the use of the Service by Room Owners, whose Room or Rooms are visible in the Service, can be found in Regulations for Businesses available at https://panel.lock.me (soon).

  4. The Service is available publicly. Use of the Service is possible without registering an Account, except for the following Service functions that require Account registration:

    1. adding comments relating to Rooms,

    2. selection and remembering the preferred city of the User, used for filtering information about Rooms displayed to the User,

    3. marking Rooms visited by a User,

    4. following other Users.

  5. Use of the Service is free of charge. Any paid services are related to the User concluding a Room Booking Contract and purchasing a Voucher.

  6. Use of the Service may be anonymous except for the possibility of adding a comment regarding a given Room or marking which Rooms were visited. It is impossible to conclude a Room Booking Contract or purchase a Voucher anonymously.

  7. In the scope of the User concluding a Room Booking Contract with Room Owners, the role of the Administrator covers only the provision of the Service, via which the Room Booking Contract may be concluded. The Administrator is never a party to the Room Booking Contracts.    

  8. In order to use the Service, the User's computer or other device must meet the required technical conditions. They are as follows:

    1. Standard operating system,

    2. standard, latest version of web browser,

    3. Internet connection,

    4. active email address – to set up an account in the Service, conclude a Room Booking Contract or purchase a Voucher.

  9. When using the Service, it is prohibited for the User to provide illegal content, specifically sending such content via forms available in the Service.

 

§ 3 Service Functions (scope of services provided electronically)

  1. The Administrator provides services to the User electronically through the Service. The services consist of ensuring the following possibilities to the User:

    1. browsing the Service content,

    2. setting up an Account in the Service,

    3. concluding a Room Booking Contract,

    4. buying a Voucher.

  2. The Administrator provides a service consisting of managing an Account of a Registered User electronically through the Service. Further services consist of ensuring the following possibilities to a Registered User:

    1. adding or modifying data assigned to an Account: name and surname, profile picture, password,

    2. browsing the Service content,

    3. concluding a Room Booking Contract,

    4. buying a Voucher,

    5. adding reviews relating to Rooms along with their rating,

    6. selection and remembering the preferred city of the User, used for filtering information about Rooms displayed to the User,

    7. marking Rooms visited by a User,

    8. following other Users,

    9. connecting the Account in the Service to a Facebook account.

§ 4 Service Content

  1. The Service gathers information about Rooms available in the entire Poland.

  2. Each Room is presented on a separate page of the Service.

  3. A page with presentation of a Room contains the following:

    1. Room description,

    2. Room location,

    3. details of the Room Owner and Room Regulations – only if it is possible to conclude a Room Booking Contract for that Room via the Service,

    4. reviews and ratings of a Room.

  4. The Service also features text, graphical and video materials dedicated to escape rooms in general.  

 

§ 5 Account

  1. In order to set up an Account, the User must click “Register”, available in the top menu of the Service, fill out a registration form, submit it to the Administrator by clicking the "Set up account" button and then clicking the activation link sent to the email address indicated in the registration form.

  2. You can set up an Account in the Service also through an existing Facebook account. In such a case the User does not fill out the registration form but clicks the "Log in or register through Facebook conveniently" button.

  3. Once the Account is set up, an Account Contract is concluded between the User and Administrator, under which the Administrator is obliged to manage the User's Account in the Service, and the User is obliged to use the Service according to these Terms and Conditions.

  4. The Account Contract is free of charge.

  5. An Account Contract is concluded for a definite period with the possibility of its termination with immediate effect at any point, by sending an email to the Administrator (contact@lock.me) requesting deletion of the Account in the Service.

  6. Even if a User did not set up an Account through their Facebook account, they may connect their Account in the Service with their Facebook account.

  7. A Facebook account connected to the Account in the Service must enable clear identification of the User's identity. If such identification is not possible, the Administrator may block the User's Account until the Account in the Service is connected to a Facebook account that enables clear identification of the User's identity.

  8. When connecting an Account in the Service to a Facebook account or when setting up an Account in the Service using a Facebook account, the User grants their consent for their Facebook profile to be linked in all comments added by the User. This also applies to reviews added in the Service prior to connecting the Account in the Service to a Facebook account.

  9. The User logs into the Account specifying their email address assigned to the Account (provided in the registration form) and password defined by them. If a User set up an account through their Facebook account, they may log into the Account also using their Facebook account.

  10. When logging into the Account, the User obtains access to the Account dashboard where they can manage the Account by adding or modifying their data, browsing their reviews about Rooms and setting preferred cities.

  11. When setting up the Account, the Service mechanism assigns a particular name to it. The User may change it at any time in the Account dashboard.

  12. When adding data to the Account, the User provides a non-exclusive license that is not limited in terms of time and territory, for publishing such data in the Service, in social media managed by the Administrator relating to the Service as well as in the newsletter sent by the Administrator to its subscribers.

  13. When adding a profile picture to the Account, the User declares that they are authorised to use it online and provides a non-exclusive license that is not limited in terms of time and territory, for publishing such a profile picture in the Service, in social media managed by the Administrator relating to the Service as well as in the newsletter sent by the Administrator to its subscribers.

  14. If the profile picture contains an image of the User, the User grants a consent, for publishing such an image in the Service, in social media managed by the Administrator relating to the Service as well as in the newsletter sent by the Administrator to its subscribers.

  15. The Administrator reserves the right to verify the authenticity and validity of the email address assigned to the Registered User's Account at any time, by sending a message to the above address with a request to confirm it. If the email is not confirmed within 48 hours from delivery of the message, the Registered User's Account will be blocked until it is confirmed by the User.

 

§ 6 Room Booking Contract

  1. The Service enables a User to conclude a Room Booking Contract with the Room Owner, under which the Room Owner is obliged to provide a Room to a User on the date and time selected by the User and on principles specified in the Room Regulations, while the User is obliged to make a payment to the Room Owner, whereas the payment shall be made in advance via the Service mechanisms,

  2. To conclude the Room Booking Contract, the User must create an order, selecting the following:

    1. date and time of the visit,

    2. room,

    3. the price option corresponding to the selected date and time,

    4. number of people.

  3. After making the respective choices, the User must add the order to cart.  

  4. When adding an order to cart, the User may create further orders and pay for them collectively within 20 minutes of adding the first order to cart. After this time lapses, the session expires and all items are removed from the cart automatically.  If the User does not wish to create another order, the cart will be considered complete and the User can follow the procedures described below. In each case, the User has 20 minutes from adding the first order to cart, to make the payment.

  5. After all items are added to cart, the User must accept the Terms and Conditions of the Service as well as Room Regulations, to which the Order relates. If the order relates to several Rooms, the User must accept the Regulations applicable to each of them. Acceptance of the regulations is voluntary but required for submitting the order.

  6. After accepting the regulations, the user must make a payment.

  7. The payment is possible via the payment system service or with the use of a Voucher.

  8. Use of the Voucher consists of entering the individual number and security code in the appropriate fields.

  9. The order is submitted by clicking "Buy and pay".

  10. If the value of the redeemed Voucher covers the entire amount of the order, the User will be redirected to the Service page with order confirmation, after clicking "Buy and pay".

  11. If the User did not use the Voucher or the value of the redeemed Voucher did not cover the entire amount of the order, the User will be redirected to the payment system page to make the payment, after clicking "Buy and pay". After making the payment, the user will be redirected to the Service page with order confirmation.

  12. Once the User is redirected to the Service page with order confirmation, the Room Booking Contract is concluded between the User and Room Owner. If there were several orders in the cart, once the payment is made, the corresponding number of Room Booking Contracts is concluded (equal to the number of orders in the cart).

  13. The User shall receive an order confirmation to their email and confirmation of concluding a Room Booking Contract or Contracts.

  14. The Room Booking Contract shall be executed by the Room owner in line with the Room Regulations.

 

§ 7 Vouchers

  1. The User may purchase Vouchers via the Service, to be used as a payment method when concluding Room Booking Contracts via the Service.

  2. Details regarding sales of Vouchers can be found in separate regulations available soon.

 

§ 8 Reviews

  1. A Registered User who set up an account in the Service through their Facebook account or connected their Account in the Service with their Facebook account, may add reviews and ratings regarding Rooms. The Facebook account connected to the Account in the Service must be authentic and active. Once the Facebook account connected to the Account in the Service is deleted, it shall be disconnected from the Account in the Service. If a fictional Facebook account is connected to the Account in the Service, the Administrator may block the possibility of adding reviews by the User.

  2. It is prohibited to add reviews in the Service by Users who used a Room free of charge, specifically in connection to running a test game. This prohibition shall not apply if a User has received a refund from the Room Owner due to dissatisfaction of a User from a visit in the Room, under the Room Booking Contract. This prohibition applies only in a situation where the free use of the Room was agreed prior to visiting it.

  3. It is prohibited for Room Owners to add reviews in the Service.

  4. Adding reviews is also prohibited for employees of Room Owners, their contractors, people providing services to them based on contracts or by any other entities associated with Room Owners or providing services to their benefit, relatives, friends, if such reviews aim at unfair strengthening of the position, image or rating of the Room Owner or to weaken the position, image or rating of other Room Owners.

  5. If the Administrator discovers that a review added in the Service was written by the Room Owner, the Administrator may publish information about unfair practices of the Room Owner, on pages of the Service where Rooms of a given Room Owner are presented or on the page of the Service presenting the Room Owner.  

  6. If the Administrator discovers that a review added in the Service was written by a User mentioned in item 4 above, and aims at unfair strengthening of the position, image or rating of the Room Owner or to weaken the position, image or rating of other Room Owners, the Administrator may publish information about unfair practices of the Room Owner, on pages of the Service where Rooms of a given Room Owner are presented or on the page of the Service presenting the Room Owner.

  7. If the Room Owner does not agree with the Administrator's decision regarding the character of the review, in terms of the premises mentioned in item 4 above, the Room Owner may contact the Administrator in order to clarify the issue. The Administrator may be contacted at contact@lock.me.

  8. Reviews may be added from the pages of the Service presenting particular Rooms.

  9. When adding a review, you may also rate a Room taking into account three criteria: general satisfaction, services and atmosphere. Ratings are awarded in the range from 1 to 10.  

  10. When adding a review, the User declares that they are authorised to publish the content of such reviews and grants a free-of-charge, non-exclusive license to the Administrator, which is not limited in terms of time and territory, for publishing the review in the Service, social media managed by the Administrator regarding the Service as well as in the newsletter sent by the Administrator to its subscribers.  

  11. When adding a review, the User also grants a consent for publishing a link to their profile in the Service, for the purpose of presenting a given review.

  12. It is prohibited to add reviews violating the law or good customs, and particularly reviews that are unreliable, untrue, slandering, defaming, offensive, promoting aggression, hate or discrimination.

  13. It is prohibited to provide details of the story or Room elements (spoilers) in the review content.

  14. The Administrator reserves the right to moderate or delete reviews that violate prohibitions specified in items 2, 3, 4, 12 or 13 above.

  15. The Administrator reserves the right to block an Account of a User who added a review that violates the provisions, according to items 2, 3, 4, 12 or 13 above.

  16. The Administrator reserves the right to verify whether a User who added a review regarding a Room, actually visited that Room. For this purpose, the Administrator may send a message to a User with a request to confirm the date of the visit at a particular Room. If there is no response or the response is untrue, the Administrator may delete the disputable review and block the User Account.

  17. In the case of a negative review regarding a Room, the Administrator may ask the User who added the review to provide a consent for disclosing the email address of the User to the Room Owner, to which the review relates, in order to clarify any issues.

  18. If a Registered User states that a review available in the Service violates the prohibition specified in items 2, 3, 12 or 13 above, they may submit this fact to the Administrator using the "Report review" feature.

  19. The User may browse all reviews added by them in their Account.

  20. A User who registered their room via the Service is entitled to writing a review marked as "Verified Review". The right is also applicable to one person from a team, whose visit was booked via the Service, regardless of the number of people visiting a Room, whose email address corresponds to the email specified in the booking process.

 

§ 9 Visited Rooms

  1. A Registered User may create their list of visited Rooms.

  2. A Room is added to the list of visited Rooms by means of writing a review regarding a visited Room or marking a proper option on the Service page presenting a given Room.

 

§ 10 Following Users

  1. A Registered User may follow other Registered Users.

  2. Following involves receipt of email notifications about reviews added in the Service by a followed User.

  3. In order to follow a given User, add them to a list of followed people by clicking the 'eye' icon.

 

§ 11 Use of the Service by a Consumer

  1. A Consumer has the right to withdraw from the Account Contract without specifying a reason within 14 days from its concluding.

  2. In order to withdraw from a Contract, the Consumer must notify the Administrator about their decision on withdrawal by means of a clear statement - for instance a notification sent my post, fax or email.

  3. In order to respect the date for withdrawing from the Contract, a Consumer shall provide information regarding the exercise of the right to withdrawal to which they are entitled, prior to the lapse of the period for withdrawal.

  4. The Administrator is not a party to Room Booking Contracts concluded by the User via the Service, but the User is hereby notified that the provisions regarding withdrawal from the Room Booking Contract can be found in the Room Regulations in each case. A Consumer may also contact the Administrator in order to obtain information regarding the possibility of withdrawing from the Room Booking Contract.  

  5. A Consumer has the possibility of utilising out-of-court methods for processing complaints and making claims regarding the Account Contract or Voucher Purchase Contract. The Consumer 's rights include:

    1. applying to a permanent consumer court of arbitration with a request to resolve a dispute resulting from a concluded contract,

    2. applying to the provincial inspector of the Commercial Inspection with a request to initiate a mediation procedure regarding an amicable closure of a dispute between a User and Administrator,

    3. obtaining help of a regional (local) consumer rights advocate or a social organisation, which is in charge of consumer protection.

  6. More details regarding out-of-court methods for processing complaints and making claims may be found at: http://www.uokik.gov.pl.

  7. A consumer may also use the ODR platform available at: http://ec.europa.eu/consumers/odr. The platform is used for resolving disputes between consumers and entrepreneurs aiming at out-of-court resolution of disputes regarding contractual obligations resulting from an online sales contract or a service provision contract.

 

§ 12 Complaints

  1. The User may submit complaints regarding the use of a Service and Account Contract.

  2. The Complaint should contain the following:

    1. identification of a User,

    2. subject of the complaint,

    3. circumstances justifying the complaint,

    4. request of a User regarding a complaint.

  3. Complaints may be submitted by email to the Administrator's address: contact@lock.me.

  4. The Administrator shall process complaints within 14 days from delivery of the complaint to the Administrator. The User shall be notified about the result of the complaint in the same way in which the complaint was submitted.

  5. The Administrator is not a party to Room Booking Contracts concluded by the User via the Service, but the User shall be hereby notified that it may submit complaints regarding execution of Room Booking Contracts also through the Administrator, by sending an email to: contact@lock.me. The complaint shall include identification of the User, indicating the Room Booking Contract to which the complaint relates, justification for the complaint as well as requests regarding it. The User may utilise the complaint form template available at https://lock.me/complaint but this is not mandatory. The Administrator shall hand over the complaint to the Room Owner who will respond to it.

 

§ 13 Reporting Violations

  1. If a User discovers that any content, subject to item 2 below, available in the Service, violates their rights or interests, such a fact may be reported to the Administrator along with a justification, through the violation report form available at https://lock.me/abuse.

  2. When it comes to reviews regarding Rooms available in the Service, any violations shall be reported by using the "Report Review" option available next to a given review. The Administrator shall not accept reports submitted by email. Reports are not confidential which means that their content and the entire correspondence with the Administrator resulting from the reports is available to each User of the Service after clicking a special link seen next to a review, regarding which the report was made.

  3. The report must evidence the probability that a violation of rights or interests of the User actually took place. The User must justify their report presenting appropriate facts or circumstances confirming that a violation of their rights or interests actually took place. Reviews and comments regarding a User, their Room or Room services that are offensive or contain obscene language shall be considered a violation of the rights or interests of the User.

  4. Negative reviews about a Room shall not be considered a violation of rights or interests of the User, unless such reviews contain offensive or obscene language or information that is objectively untrue, whose untrue character may be evidenced.

  5. Subjectively negative judgement by a User regarding a negative review regarding the User, their Room or Room services shall not affect the opinion whether such a review violates the rights or interests of a User. An opinion shall be issued based on objective criteria while subjective convictions or judgement of a User shall not be taken into account.

  6. The Administrator has 14 days from submitting a report for its processing. The Administrator is not obliged to inform Users about the report status.

 

§ 15 Personal Data and Cookies

§ 16 Final Provisions

  1. These Terms and Conditions are valid as on the date of their publication in the Service.

  2. In line with Article 14 of the Act on Provision of Electronic Services, the Administrator shall not be responsible for content published by Users in the Service if the Administrator was unaware of its illegal character, and in the case of obtaining reliable information about its illegal character, if the Administrator has blocked access to it immediately.

  3. The Administrator reserves the right to amend the Terms and Conditions, due to important reasons. Important reasons justifying amendments to the Terms and Conditions include in particular a change of the commonly applicable laws, organisational changes of the Administrator, expansion of services provided by the Administrator, no further possibility of service provision by the Administrator on existing terms, the requirement of adjusting the Terms of Conditions to unfair practices of Users intending to bypass prohibitions provided for herein. The Administrator shall notify Users about the updated version of Terms and Conditions electronically (to the email address indicated in the Account). If the User does not accept the updated version of Terms and Conditions, they have the right to terminate the Account Contract at any time by submitting a statement of will to the Administrator regarding deletion of the Account.
